What is the position then when buying online from an internet auction site such as eBay? Consumer law may not apply as it may not be a consumer transaction, ie are you buying from a seller acting in the course of his business or an individual? If you are on a reputable auction site they may have their own code (see Ebay’s Safe Surf Code). Also no cooling off period is allowed when purchasing certain goods online – plane, train or hotel
